INSTRUCTIONS:

Choose one of the following rights and fully explain the civil rights and liberties that it provides to individuals under the Constitution. How does that amendment affect the work of criminal justice personnel (i.e. police, prosecutors, corrections)? Search the Internet to provide a link to a news story that provides an example where the police or the criminal justice system violated an individuals rights guaranteed in the amendment that you chose. (Although there will be some overlap, please check other student responses before answering to make sure that all of the rights receive attention).

The right to due process

The right to a speedy trial or a trial by jury

The right or a suspect to know the charges against him

The right against cruel and unusual punishment

The right to bear arms was to protect the states under their power to maintain organized militia agreements. As far as individual rights go this amendment protects possession and firearms that are being transported. The Second amendment could definitely affect the criminal justice personnel. I say this because the second amendment tried to prevent or makes people within that field use the firearms for a certain situation. However, if the officer were to get trigger happy then worse cases would perspire regarding possible lawsuits, loss of a job or even incarceration. The link I will be posting will be the Breonna Taylor case because the police violated their rights.

The right to a speedy trial is based off of The 6th Amendment, which guarantees the rights of criminal defendants, including the right to a public trial without unnecessary delay, the right to a lawyer,  the right to an impartial jury, and the right to know who your accusers are and the nature of the charges and evidence against you. According to Information from the legal Institute, it states, “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation, to be confronted with the witnesses against him, to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.” In other words, without a speedy trial prosecutors would be able to send anyone to jail for a extended time without trial. The article explains how the 6th amendment is being used in this trial. Chad Daybell is a triple-murder defendant who had agreed to waive his right for a speedy trial.
