Part 1 (35%)

Pam Summer is the women’s basketball coach at State University. She was previously a head coach at another college for ten years, during which she won two championships. She has been at State for the past five years and this past season coached her team to an NCAA championship. She asks for a new contract with more money from State. State’s Athletic Director refuses to give her a higher salary. 

Summer also discovers that Gene Aurora, the coach of State’s men’s basketball team, has been earning the same amount of money that she requested from State. Aurora has been coaching for State the past three years but before that was an assistant coach. Pam is upset because she feels she is not being paid equally with the men’s basketball coach, especially considering that she has more experience than he and that she won a national championship. She is also upset because after a recent visit to the men’s basketball team facility, she discovered that the men’s team had a far larger facility and much better equipment than the women’s team. 

Summer talks to a lawyer about her options and decides to file a lawsuit making a Title IX claim and an Equal Pay Act claim. The lawyer tells her that another client, Cindy Altman, is also interested in joining the Title IX claim. Altman is the women’s soccer coach at State. She feels that the women’s soccer team has not received the support it deserves from State. After doing some research, she learned that though women make up 55% of the student body at State, only 25% of the school’s athletes were women. She also feels that she has been subjected to inappropriate comments and sexual harassment from male colleagues in the athletic department. 

Summer and Altman get together to plan their lawsuit and compare notes. Together they realize that none of their players are earning “full cost of tuition” stipends, which are stipends paid to college athletes in addition to their normal scholarships to offset various additional costs of attending school. State’s policy is to not issue “full cost of tuition” stipends to players whose teams do not generate enough revenue to cover costs. Summer and Altman’s attorney wonders if this policy may violate antitrust law. 

State’s Athletic director hears about the potential lawsuit being prepared and turns to you, his in-house expert on legal compliance. Explain the various potential claims you believe Summer and Altman may have against State, any defenses State may have, and how a court will likely evaluate these claims. If you need additional information to make an assessment, discuss what information you would want to have.

Part 2 (65%)

New Orleans Pelicans basketball player Zion Williamson injures his knee in a preseason game and misses the first few months of the NBA season after knee surgery. The surgeon who performed the surgery informed team officials that after Williamson finishes rehab, he can play in games but should be under a strict minutes restriction. Additionally, while Williamson is rehabbing his injury, a Pelicans staff member leaks information on his rehab status and medical information, including biometric data to a member of the media, who then tweets out the information. 

After Williamson recovers and begins playing again, he travels with the Pelicans to North Carolina to play the Charlotte Hornets, which are owned by former NBA player Michael Jordan, who happens to be in his box seats watching the game with North Carolina’s governor. In the middle of the game, one of Charlotte’s players, Bismack Biyombo, taunts Williamson about his injury and pushes him. Williamson pushes Biyombo back, which provokes Biyombo to punch Williamson. Williamson’s teammates get involved, and after a brief scrum both players are ejected from the game. It is later discovered that Biyombo was injured after Pelicans player Jaxson Hayes tackled him. After being ejected, while walking out of the game Williamson sees a fan in the stands wearing a t-shirt with the name "Zion" over a depiction of his face. Williamson sees the shirt and does not like that his face and name are being used to sell shirts. 

While watching the fight on the court, Jordan comments to the North Carolina governor that it’s a shame Biyombo was ejected from the game because he had a friendly bet on the game with a friend. The governor mentions to Jordan that he has been considering suggesting to the legislature that it pass a bill legalizing sports gambling in the state. A bystander in a nearby box seat overhears their conversation and reports it to the NBA commissioner’s office.

  1. Discuss the ethical dilemmas the Pelicans medical staff and coaches might face when deciding how to reintroduce Zion to NBA games and how they should each respond. Are there any legal implications for their actions? Discuss the legal and ethical issues the team might face after releasing Williamson’s medical information. Did the staff member who provided the records to the journalist violate any laws or ethical codes? How would you advise the team about preventing problems like this in the future?
  2. Explain the right of publicity issues involved if Williamson wants to pursue a claim against the t-shirt company and any potential defenses the t-shirt company may have, including the chances of success for either side. 
  3. What are the possible tort claims that could be relevant to the fight between Williamson and Biyombo? Discuss the applicable liability standards and whether any tort claims would be likely to succeed. 
  4. Adidas has an endorsement agreement with Biyombo that involves a standard morals clause. Discuss Adidas’s options regarding Biyombo, including whether you think they could terminate their endorsement agreement with him, what defenses Biyombo might have, and which side may be more likely to prevail. If you need additional information to make an assessment, discuss what information you would want to have. 
  5. NBA Commissioner Adam Silver must consider potential cases of discipline. He must decide whether to punish the players involved in the fight and also whether to discipline the Hornets owner, Michael Jordan, for betting on the game. Explain your understanding of how the commissioner discipline process differs for players and owners and any relevant legal standards involved.
  6. After talking with Jordan at the game, North Carolina’s governor approaches you and asks about obstacles to legalizing sports betting in the state. He also wonders if fantasy sports should be included in the legalization bill. What issues will he have to discuss with the legislature when advising about crafting a legalization bill?
