3-BODY PAGES: PAPER # IP 3 ORGANIZATIONAL CHALLENGES

There is a theory that motivation can only come from within, however, as a manager you will have the responsibility to not only manage the daily activities of your employees but to also motivate them. Understanding the individual characteristics of your employees is key as this allows you to have a personal approach based on their personality rather than relying solely on your leadership style. Having a strong understanding of motivational theories will aid in your ability to motivate personnel.

In this chart complete the following:

Give a complete description of your understanding of the motivational theory.
What type of environment or situation would be best suited to each theory. Give an example of a situation you have experienced or a situation in which you believe this would have been a good fit.

6 BODY PAGES ****PAPER #IP 3 RIGHTS AND OBLIGATIONS

In 1999, a Seattle man took a popular soft-drink company seriously when one of its commercials made an offer of a Harrier jet, the famous high-tech jump jet used by the U.S. Marines. In a television commercial that aired in 1995, the company jokingly included the Harrier as one of the prizes that could be received with a mere 7 million company points. Although that sounds like a lot of points to get from drinking the soft drink company’s products (roughly 190 drinks a day for 100 years), the company also allowed customers to purchase points for 10 cents each.

The man did the math and discovered that the cost of the 7 million points needed for the jet was $700,000. He then put together a business plan, raised the $700,000 from friends and family, and submitted 15 points, the check, and an official order form with a demand for the Harrier jet.

The company wrote back, stating that the Harrier jet in the commercial was simply used to create a humorous and entertaining advertisement. They apologized for any misunderstanding or confusion people may have experienced and enclosed some free product coupons.

The free coupons did not satisfy the man, who then took the soft drink company to court. Finally, a federal judge for the Southern District of New York held that the company was only joking when it implied in its ad that it was giving away fighter jets. The judge noted that because the jets sell for approximately $23 million, no one could have concluded that the commercial actually offered consumers a Harrier jet. Instead, this was a classic example of a deal that was too good to be true.

Write a paper of 4–6 body pages that answers the following questions, including an in-depth explanation of the supporting rationale:

What are the key legal factors present in the scenario?
What are the 4 elements of a valid contract? How do they relate to the scenario in question?
What is the objective theory of contracts?
How does the objective theory of contracts apply to this case?
In your own words but based on research and analysis of relevant legal concepts and cases, why do you think the court held that there was not a valid agreement in this scenario? Provide support for your position.
Are advertisements generally considered offers? Explain.
How does this case differ from a reward situation in which a unilateral contract is formed upon completion of the requested act?
What recommendations (at least 2) would you make for a company considering an aggressive marketing campaign with giveaways of high value items? Explain the rationale behind each recommendation.

Your submitted assignment (200 points) must include a Word document of 4–6 body pages that contains your answers to the questions listed and a reference list of any sources that you used within your paper (cited properly in APA format).

5 BODY PAGES PAPER #IP5 INTERNATIONAL BUSINESS ETHICS

Antitrust laws were essentially created to stop businesses that got too large from blocking competition and abusing their power. Mergers and monopolies can limit the choices offered to consumers because smaller businesses are not usually able to compete. Although free and open competition ensures lower prices and new and better products, it has the potential to significantly limit market diversity.

Review the following examples of how mergers and acquisitions have affected the way in which companies do business.

Prepare a research paper in APA format that demonstrates your analysis of the international legal issues that are involved in both examples.

Example 1

Federal antitrust enforcers are investigating whether a multinational pharmaceutical company has attempted to minimize the impact of generic competition to one of its most profitable prescription drugs. This antidepressant drug is the company’s best seller, with sales last year of $2.11 billion, representing a 22% increase from the year before.

The Federal Trade Commission (FTC) is conducting an investigation to determine whether the company engaged in activities to prevent generic alternatives to the prescription drug from entering the market. Specifically, the FTC is challenging a practice among brand-name and generic drug manufacturers to agree to delay the introduction of the lower priced generic drugs to the market.

Answer the following questions:

Why would the drug maker want to stymie generic competition? Explain your response.
What types of legal barriers to market entry exist?
What are the possible ethical dilemmas that are present in this example?
Example 2

The boards of 2 major telecommunications companies recently agreed to a $16 billion merger that would create the world’s largest telecommunications company in the world. Although some agree that the synergy between these companies could be dynamic, others feel consumers could ultimately pay the price for the merger, depending on which company becomes dominant in the various service areas.

Answer the following questions:

Why do you think consumer advocates have expressed concern over such merger possibilities?
Other than pricing, what are some pitfalls that consumers might have to deal with when 2 major companies merge?
What are the possible ethical dilemmas that are present in this example?
