Peter owns a landscaping business and has been talking to a new client, Suh, about doing a project. Suh needs some work done on both the front and back yards of her house, including new lighting, flowers, plants, shrubs, a tree, and help getting the grass looking good again. Peter says that for $2,500 he will provide and install 12 outdoor lights; provide and plant 8 rose bushes, 24 succulents, 6 shrubs, and a lemon tree; and provide and apply manure and grass seed for Suhs front and back yards. Peter explains that $2,100 will be for his labor and $400 for the supplies.
Suh tells Peter that she will agree to the price only if Peter will throw in a second lemon tree.
Do Peter and Suh have a contract? Explain why or why not, including whether you think there is a meeting of the minds (offer and acceptance), consideration, capacity, legality, consent, and writing requirement.
Question 2. (4 points):
Peter tells Suh that he agrees to also provide and plant a second lemon tree for the same total price ($2,500). Peter says he can start next Saturday, January 22, 2022, and Suh says “that sounds great, that works for me.”
Do Peter and Suh have a contract? Explain why or why not. You do not need to go through each contract requirement again, but tell me what is different from Question 1.
Question 3. (5 points):
Presuming that Peter and Suh have a contract, would common law or the UCC apply to the contract? Why?
Question 4. (6 points):
Peter is making a list of the supplies needed to start Suhs project when he sees an advertisement in the newspaper for his local home improvement store. The advertisement says the store is having a sale on lawn care supplies and that the first 10 people through the door on Saturday, January 22, 2022, who show this ad at the customer service counter will get one free Murrays Lighting Fixture. Peter likes Murrays products and uses them regularly.
On January 22, 2022, Peter shows up at the store a few minutes before it opens and waits in line. The doors open and Peter is the seventh person in the store. He shows the ad at the customer service counter, but he is told that the store ran out of all Murrays Lighting Fixtures and they wont be able to give him one. Peter is very disappointed.
Did Peter and the store have a contact? Explain why or why not.
