Management Ethics At The Corporate Level

Question 1

Organico Corporation has supermarkets and coffee shops nationwide that specialize in providing fair trade products and organic produce.

Paul, who is Organico’s CEO, seeks your advice regarding recent issues of ethical and legal concern relating to employees of the company.

Sylvia, a supermarket employee of Organico, has worn a shirt to work for several months. Printed on the shirt is, “Shop at Grower… The prices are lower.” Grower is a rival chain of supermarkets. Sylvia’s supervisor, Gerry, sends her home to change. Gerry says she is breaking the dress code. Sylvia tells him no one has complained before. When Sylvia gets home, she lets off steam on social media. She posts a photo of herself in front of Organico making a rude gesture. The caption says she thinks that Organico’s prices are too high. Sylvia adds, “I have a right to express my opinions at work!” The next day, Gerry fires her. Sylvia responds angrily that Gerry should not dismiss her, as she has been a first-class employee with good evaluations, and that she has a right to free speech. Sylvia points out that Gerry did not fire Carmen, another co-worker, for wearing a crucifix at work, even though everyone had been told not to wear jewelry at work. Sylvia also finds out that Gerry had fired another worker, Ken, for parking his truck in the parking lot. The truck had a bumper sticker that read, “Support your gun rights.” However, Gerry had not fired workers who came to work with bumper stickers supporting rival candidates.

Paul, the CEO of Organico, asks you to review the cases of Sylvia, Carmen, and Ken, as well as the actions of Gerry. When advising Paul, you are told to provide detailed advice that includes identifying ethical theories that might apply; analyze the ethical and legal problems; apply legal and ethical best practice when firing employees, including First Amendment rights, and researching relevant cases to illustrate your advice.

Many Organico supermarkets use individual themes as a marketing tool to stress a, “look” or image, and appeal to younger customers. There are also themed coffee shops that offer organic foods from various countries. The Chicago coffee shop has a South American theme. Oliver, who is white, is turned down for a job as a waiter, despite his experience in catering. Organico’s human resources director, Sasha, employs an Argentinian-born waiter with less experience to, “fit the theme.”

In another supermarket that is Asian-themed, Organico hires people of all nationalities. However, only good-looking young Asians are trained to serve customers in the supermarket. The other employees are put in warehouses and store rooms. Deshon, an African-American employee, currently working in the warehouse, has sales experience. He applies for a job to serve customers and is turned down. Sasha explains to Deshon that the company is promoting a particular, “look” that needs to be authentic. It appears that Sasha had even turned down an Asian applicant, Bahula, for work because she is overweight and ugly.

Recently, Roger, who is employed in Organico’s HR department, claims that he has been sexually harassed by Sasha. Roger says he was promised promotion by Sasha despite being a poor candidate, if he had sex with her. Sasha admits she is in love with Roger, but says he agreed to the relationship.

Rita, who is a newly-hired employee in another Organico supermarket, claims her boss, Keith, put his arms around her every day, and allows other employees to make sexist jokes in front of her.

Paul, the CEO of Organico, asks you to review the cases of Oliver, Deshon, Bahula, Roger, and Rita, as well as the actions of Sasha and Keith. When advising Paul on the fact situation, you are told to provide detailed advice that includes identifying ethical theories that might apply; analyzing the legal and ethical problems; applying legal and ethical best practice when firing employees, including their civil rights, and research relevant cases to illustrate your advice.
