Overview

On January 6, 2021 President Trump gave a speech encouraging his supporters to march on the U.S. Capitol to protest his election defeat, which he called “take back the steal”.   Consequently thousands of President Trump’s supporters  violently stormed the U.S. Capital and caused  numerous injuries and one  fatality to the Capital Police.

In today’s Chapter on Civil Liberties, direct incitement test is discussed on page 73 of your hard copy textbook.  The definition of “direct incitement ” is as follows :  

Test articulated by the Supreme Court in Brandenbury v. Ohio holding the first Amendment protects advocacy of illegal actions unless lawless action is intended and likely to occur.

Assignment 

After reviewing the video and definition of direct incitement, discuss in a one page essay  whether President Trump  intended to advocate “lawless” action and likely knew it would occur.
