The issue is: did the bartender have a legal duty to try to prevent the fight and does the hotel have liability in Bradley Smith’s injuries. Also, consider the bartender’s ethical and moral responsibilities in this case.
- Review the case of Kuehn v. Pub Zone on pp. 7-8, which will help you determine whether there was a legal duty.
- Apply the court’s decision in the Kuehn case to this case and come to a decision on the issue. Explain the legal standard established in Kuehn and whether it applies to this case? State your reasoning.
- For the ethics/morality aspect, what do you think?
