“HHIPAA and HITECH are two different but related statutes that regulate use, access, and disclosure of protected health information. As we know, HIPAA was enacted in 1996 and HITECH in 2009. The HITECH regulations, finalized in the 2013 HIPAA-HITECH Omnibus Rule, clarified some HIPAA provisions and added other new requirements.
Four important matters that HITECH addressed were:
- Introduced Meaningful Use of electronic health records, including providing financial incentives for adopting and meaningfully using EHR;
- Strengthened the penalties for violations of the Privacy Rule;
- Introduced the Breach Notification Rule clarifying what constitutes a breach and producing requirements for notifying affected patients; and
- Added patient rights to request an accounting of disclosure of electronic PHI (ePHI), in addition to the accounting of disclosure of non-electronic data.
