  • SCENARIOS ONE: IS SOCIAL MEDIA KILLING FREE SPEECH

In recent years, Facebook and Twitter have come under scrutiny for suspending the accounts of various controversial political and social activists, using fact-checkers to remove and suspend accounts of those whom they deem to have perpetrated the spread of misinformation, whether it is in regards to the 2020 Presidential Election or the COVID pandemic and other controversial topics. 

Some people voice concerns about the overreach of social media in silencing voices on platforms that have evolved over time to become public forums. They argue that social media is censoring the speech of these individuals/organizations because the platforms do not agree with their views, and are stifling their right to be heard by the general public.  They believe these platforms should be seen as a public utility and as such must adhere to the constitutional protections afforded under the First Amendment; a neutral forum, not engaged in political speech.

Others argue that social media companies are private entities that can decide what type of speech they wish to promote and have a right to censor expression considered hate speech or speech that can lead to incitement of violence based on their terms and conditions, including political officials. Some argue that, up until recently, Twitter nor Facebook has not done enough to remove violent posts threatening harm to others and their hands-off approach has created a possibly harmful environment. 

In the Biden v. Knight First Amendment Institute case before the US Supreme Court, Justice Clarence Thomas, in his concurrence, wrote: "Today’s digital platforms provide avenues for historically unprecedented amounts of speech, including speech by government actors. Also unprecedented, however, is the concentrated control of so much speech in the hands of a few private parties. We will soon have no choice but to address how our legal doctrines apply to highly concentrated, privately owned information infrastructure such as digital platforms."
