In his Nicomachean Ethics, Aristotle wrote the following: "…legislators make the citizens good by forming good habits in them, and thus is the wish of every legislator, and those who do not effect it miss their mark, and it is in this that a good constitution differs from a bad one."
John Adams, the 2nd U.S. President, wrote the following: “There is nothing which I dread so much as a division of the republic into two great parties, each arranged under its leader, and concerting measures in opposition to each other. This, in my humble apprehension, is to be dreaded as the greatest political evil under our Constitution.” This was a common view not only of Adams but also of several other of his founding colleagues who were instrumental in the drafting of the U.S. Constitution.
Is Aristotle’s ideal of what makes a good constitution reflected in the U.S. Constitution and our legislature or has John Adams’ fears and those of his founding colleagues been realized? Provide a response based on your general knowledge and scholarship in the area. As always in any of my law courses, bare beliefs and generalized feelings are irrelevant since this is a law course and we focus on facts and law.
