In October 2018, the Victorian Government asked the Victorian Law ReformCommission (VLRC) to ‘recommend any legislative, procedural or administrativechanges to Victoria’s committal procedure, which could reduce trauma experienced byvictims and witnesses, improve efficiency in the criminal justice system and ensure fairtrial rights’ (https://www.lawreform.vic.gov.au/projects/committals/terms- reference-committals).Your task is to prepare a submission to the VLRC that addresses the followingquestion: Should Victoria maintain, abolish, replace or reform the present committalsystem?This is a research paper. It is not simply seeking your personal views. Yoursubmission must therefore be based on the research you have conducted, whichshould be properly cited using the AGLC4.While your submission should persuasively argue for a specific approach, it shouldnot be entirely one-sided. It should demonstrate a familiarity with opposing points ofview and address any counter-arguments. For examples of real submissions to pastVLRC inquiries, see Jury Empanelment Submissions; Victims of Crime Submissions;and Mental Impairment Submissions. This is a research paper that requires you to refer to materials beyond thosementioned in the unit’s Reading Guide or in lectures.You must submit an Assessment Task Cover Sheet with your assignment, whichcertifies that the assignment is your own work and that it complies with the word limit.The cover sheet is available online (see https://www.monash.edu/law/current-students/resources/forms) or from the Student Services desk.The Chief Examiner (Jamie Walvisch) is only able to grant a short extension forsubmission of the paper (not exceeding two days). Applications must be madeusing the ‘Assignment Short Extension Application form’ (available athttps://www.monash.edu/law/current-students/resources/forms), and should besupported by documentary evidence. Where an extension is sought on theground of illness, a medical certificate must be supplied.
