Joe Peculiar owns many, many cats and relies heavily on regular shipments of food, litter, and cat toys to be delivered to his home every week by the Amazon Prime online ordering and delivery service. This service has gone smoothly for the past several years during which Joe has been a frequent Amazon Prime customer.
Without warning, Joe’s deliveries began to disappear from his front porch. Joe received online confirmations when Amazon delivered his packages, but Joe has arrived home on numerous occasions to find that those packages were not there. After nearly a dozen similar experiences, Joe installed a hidden video camera on his front door to record his porch, front yard, and the public street in front of his house.
Upon the next confirmed Amazon delivery and absent package, Joe watched his recorded video where a woman, later identified by police as Carol Robbins, drove slowly past Joe’s house in her car, stop, collected Joe’s Amazon package off his porch, and drove off with the package.
Outraged, Joe decided to end these thefts once and for all. A self-proclaimed expert on firearms, Joe rigged an intricate system inside a typical-looking Amazon box so that it would fire BB-gun pellets out of the box when it was next opened. Joe placed that rigged box on his front porch. Several days later, that same package disappeared and Joe again confirmed via video that Carol had again driven by and removed the rigged Amazon package from his porch.
The day after the theft of his rigged package, Joe was visited by police officers who served him legal papers that informed him that he had been named in the lawsuit by a woman named Carol Robbins who had opened his rigged Amazon package, been shot in the right eye by BB pellets, and was now suing Joe for her eye injury (now hidden under an eyepatch) and related issues.
After consulting with a lawyer, Joe filed a motion to dismiss for judgment on the pleadings based on Carol’s legal claims and counter-sued Carol for her thefts of his Amazon packages.
Joe also added Amazon in his countersuit, arguing that Amazon had not reasonably acted to protect his packages from being stolen after having had multiple opportunities to do so during the past several months.
